1.6 The right to make a purchase at the E-Shop has:
1.6.1 Individuals over the age of 18 years, whose capacity is not limited by a court order. Individuals younger than the age of 18 can only make a purchase with a written consent from a parent or a guardian;
16.2 Legal bodies and their authorized representatives.
2.1 In order to make a purchase the Buyer must register and login at the E-Shop by entering his user name and password. When making a purchase the Buyer must provide his personal data. This data is used to identify the Buyer and to complete the order. Data required: full name, delivery address, e-mail (this is used only to inform the buyer about the delivery status), phone number, delivery types, payment methods and other information that could be required to complete the order.
2.2 All personal data collected by the Seller is considered confidential and undisclosed. The seller agrees not to disclose this information to third parties, except to the Seller’s partners in charge of payment or delivery. Any other exceptions must be discussed and agreed by both the Seller and The Buyer. Personal data could be disclosed under the terms of Lithuanian law.
2.3 The Buyer is responsible of protecting his user name and password. It is necessary to log out every time when leaving the E-Shop. The Buyer is not responsible of any responsibility if the Seller has failed to protect his user name or password or disclosed it to third parties.
2.4 By registering on E-Shop the Buyer confirms that he agrees to give the Seller the right to collect, organize, and manage his/her personal data, collected directly and indirectly, according to Lithuanian law.
2.5 The seller confirms that Buyer’s personal data (e-mail address, phone number, delivery address) will not be used for marketing purposes except the case when the Buyer agrees to receive such information. The buyer can choose to agree or deny during the registration process.
2.6 The Buyer accepts that several technical files will be downloaded automatically from E-Shop server to his computer. These files would be used only for properly displaying information from the E-shop.
2.7 The Seller has a right suspend or ban the Buyer from using E-Shop services without any prior notice. The seller has a right to discontinue any services of E-Shop without any prior notice
3.1 The successful placement of the order at the E-Shop is considered to be an official sales contract. The contract between the Buyer and the Seller is made when the Buyer has formed the shopping cart, entered his personal data, chosen the payment method and pressed the “Confirm the order“ button.
3.2 Every contract between the Seller and the Buyer is kept for records at the E-Shop database.
4.1 The buyer has a right to place an order at the E-Shop.
4.2 The buyer is obliged to accept the delivered items and pay the full price plus delivery costs.
4.3 The buyer is responsible for supplying the correct information in registration form. The buyer accepts any liability and the cost of loss if the supplied information is incorrect.
4.4 The buyer is obliged to protect his/her user name and password, keep them in secret, and use it only by himself. If the Buyer suspects that this security has been compromised the Buyer is obliged to inform the Seller as soon as possible. Every purchase made by a successfully logged in user is considered to be made with the full consent of The Buyer and the Buyer is obliged to comply with all the terms of contract.
4.5 The Buyer is responsible for updating personal information as soon as possible.
5.1 If the Buyer is intentionally tampering with the stability of the E-Shop and its operations the Seller has a right to remove or suspend Buyer’s account from the E-Shop without any prior notice.
5.2 The Seller has a right to remove or suspend Buyer‘s account from the E-Shop without any prior notice.
5.3 The Seller is responsible for creating conditions for the Buyer to successfully use the services of E-Shop.
5.4 The Seller is obliged to deliver the goods to the address, supplied by the Buyer.
5.5 If the Seller can not deliver the goods the Seller is obliged to suggest the Buyer a replacement or issue a refund. In this case the Buyer has a right to ask for a refund without accepting a replacement. The refund must be issued within 7 workdays.
5.6 The Seller must protect all the data supplied by the Buyer and use it only for delivery and payment purposes. Personal data is collected according to Lithuanian law.
5.7 The Buyer is not responsible for any content outside the E-Shop. The buyer is not responsible for the content of websites that are linked from and to the E-Shop.
6.1 At the E-Shop products are listed individually as items with full description and price.
6.2 According to selected user interface language prices are given in Lithuanian currency (Litas) or in Euro. Lithuanian VAT is included in price.
6.3 Delivery cost is not included in the price. The delivery is free when the full price of goods is more than 125 Lt (in Lithuanian territory). Otherwise the delivery price is 10 Lt (in Lithuanian territory). International delivery prices vary due to delivery destination.
6.4 Sometimes color, shape and other physical appearance in the image of an item can differ from the reality. This is due to different monitor screen sizes and user preferences. The Seller always gives full and accurate description in text for every listed item.
6.5 The Seller reserves the right to change the items and prices at any moment without prior notice
6.6 The Seller is obliged to post all the items that are paid for by the Buyer. The Buyer is not responsible for any mistakes done by the Seller’s errors in order placement.
7.1 The Seller starts the delivery process after the payment is received and cleared.
7.2 The Buyer has to make the payment in 3 workdays after the purchase.
7.3 The Seller can select one of the following payment methods:
7.3.1 Money transfer at a bank.
7.3.2 Money transfer using electronic banking.
7.3.3 Mokėjimai.lt services.
7.3.4 Paypal services.
7.4 The seller does not take any responsibility of third party services provided by banks or Mokejimai.lt (this service is administered by "EVP International", UAB, Mėnulio st. 7, LT-04326, Vilnius, Lithuania; Organiation code 300060819, VAT code LT100001261114) or Paypal. The seller does not take any responsibility of any errors caused by the Buyer supplying incorrect personal data to these third party services (incorrect bank account number, incorrect order number, etc.)
8.1 Items are delivered by post or delivery agent or any other Seller’s partners. Full delivery cost is paid by the Seller.
8.2 Delivery can be delayed due to unforeseen circumstances. The Seller is responsible for informing the Buyer about the current delivery status.
8.3 If not mentioned otherwise items to EU countries are delivered in 5-10 workdays, to the rest of the world in 10-20 workdays from receiving the payment. Items are delivered worldwide.
8.4 The Buyer is responsible for checking if the package and the items are correct, not damaged or have not been tampered with. If the Buyer accepts the package from the delivery agent and places his signature on delivery documents it is considered that there were no problems with the delivery, package or items.
8.5 The successful delivery is made when the items are delivered and accepted by the Buyer. If the delivery is not made within 30 days from the payment the Buyer must contact the Seller no latter than in 7 days. In case of Buyer failing to comply with these rules the Seller carries no liability of the loss of items.
8.6 If the delivered items differ from the ordered the Buyer must contact the Seller no later than in one day after the delivery. The Seller is obliged to make any corrections and solve any problems if they were caused by The Buyer or its partners.
9.1 Item returns are regulated by the orders of The Ministry of Economy of the Republic of Lithuania: No. 258 „Dėl daiktų pardavimo ir paslaugų teikimo, kai sutartys sudaromos naudojant ryšio priemones taisyklių patvirtinimo“, and No. 217 „Dėl daiktų grąžinimo ir keitimo taisyklių patvirtinimo“.
9.1.1 Items can be returned if size is not applicable or the item is damaged or defective.
9.2 The returns of poor quality items are accepted within 7 days from the original delivery date. The Seller is obliged to make a full refund or send another item.
9.3 The returns are accepted when the Seller submits a written request. This request must contain the delivery date, item names, order number and the reason for a return. Written request must be included in the return package along with returned items.
9.4 The Buyer can choose between a refund and receiving another item (of same model). In case the item is out of stock the Seller issues a full refund. Refunds for delivery costs are not available for combined deliveries. In case there is a difference in price that difference must be paid by the Buyer.
9.5 Returned items are accepted only in original packing with a completed „Item for return“ form.
9.6 The Buyer is responsible for packing the items for return. Returns are not accepted if the items are not properly packed or are not sent in full.
9.7 The returned items must not be used damaged or tampered with. Items must have all their original labels and packing. The Buyer is allowed to unpack the items for viewing purpose only.
9.8 Returns are accepted in person to this address: J.Jasinskio st. 8, LT-01112 Vilnius, Lithuania. Or by post or delivery agencies. The full price of a return delivery is paid by the Buyer.
9.9 The Seller is obliged to make a refund or send another item in 7 workdays from receiving the returned item if it is applicable for all rules described in paragraph 9.7.
10.1 All disagreements between the Seller and the Buyer shall be settled by a negotiation. Failing the negotiation, disagreements are resolved before the courts of the Republic of Lithuania.
